I have a client looking for investment property, so I start doing the legwork. I come across an intriguing off-market property advertising favorable zoning — something that immediately catches my attention. But there’s a problem:
No property address.
No parcel ID#.
No legal description.
No supplemental documents to help identify the property.
So, I reach out to the advertising agent, and they provide an address. But here’s the catch — the county doesn’t even recognize that address in public records. Not exactly helpful.
I request the parcel number, and after some digging, I finally identify the property. And that’s when the red flags go up:
🚩 Issue #1: The advertised zoning is incorrect.
This could seriously mislead a buyer. If someone purchases based on false zoning info, they might find out too late that the property can’t be used as intended — for rentals, commercial purposes, or development. If this is discovered before closing, the contract could even be considered void due to a lack of mutual agreement.
🚩 Issue #2: The property was acquired through a tax sale.
Why is that a red flag? Because it raises questions about marketable title. Without a marketable title, the property may be uninsurable and subject to redemption rights or hidden liens. In most cases, buyers can’t secure financing to purchase, construct, or develop until the title is cleared — which could take years.
